May 4, 1861 – The Governor of Delaware’s Proclamation

Governor Berton, of Delaware, has issued his Proclamation in response to the President’s call for troops, stating that the laws of the State do not confer upon him any power to comply with the Secretary of War’s demand for one Regiment from Del.—The Governor, however, recommends the formation of volunteer companion for the protection of the lives and property of the citizens of the State.

Such companies when formed, will be under the control of the Stale authorities, though not subject to be ordered by the Executive into the United States’ service; the law not vesting in him such authority.—They will, however, have the option of offering their services to the General Government, for the defence of its capital and the support of the Constitution and Laws of the Country.
